Back pay from court rulings must be attributed to the year the judgment becomes final

A retired civil servant enquired as to which tax year should be declared for back pay received in 2013 following court rulings. The Directorate General of Taxes (DGT) ruled that such payments must be attributed to the year in which the judicial resolution becomes final, and that the reduction for irregular income is not applicable.

The DGT's ruling

Los importes de rentas del trabajo no satisfechos por encontrarse pendiente de resolución judicial la determinación de su cuantía se imputan al período impositivo en que la resolución adquiere firmeza. Asimismo, no procede la reducción del 40 por ciento del artículo 18.2 de la LIRPF, ya que los atrasos no se consideran rendimientos obtenidos de forma notoriamente irregular ni presentan un período de generación superior a dos años al derivar de resoluciones distintas.
