Free contribution of separate property to a community property regime triggers capital gains or losses for Income Tax purposes

A spouse wishes to contribute their primary residence (separate property) to the community property regime free of charge. The Directorate General for Tax Affairs (DGT) has ruled that, although the community property regime itself is not a taxpayer, the transaction alters the composition of the contributor's assets and triggers a capital gain or loss based on half the value of the asset.

The question raised

Taxation under Personal Income Tax regarding its contribution.

The DGT's ruling

The community property partnership is not a taxpayer for Personal Income Tax purposes; therefore, the taxpayers are the spouses. Upon the contribution of a separate asset, ownership passes to both spouses in equal shares. This entails an alteration in the composition of the contributor's assets, generating a capital gain or loss for 50% of the asset. The gain shall be determined by the difference between the acquisition and transfer values of said half.
