Resident Spanish companies not required to appoint a Spanish representative

A Spanish limited liability company with a single foreign resident manager asks whether it must appoint a legal representative in Spain. The DGT responds that, as the company is resident in Spain, it is not subject to the obligation to designate a representative with a Spanish address.

The DGT's ruling

La representación legal tributaria de una entidad corresponde a quienes ostenten la titularidad de sus órganos de representación. Al ser la sociedad residente en territorio español por haber sido constituida conforme a las leyes españolas y tener domicilio social en España, no tiene la obligación de designar un representante con domicilio en territorio español según el artículo 47 de la LGT.
