Beneficial ownership of shares must be taxed under Wealth Tax

A Spanish resident received beneficial ownership of foreign shares by donation. The DGT clarifies that such ownership is subject to Wealth Tax and examines the obligation to report foreign assets.

The question raised

Whether the Inheritance and Gift Tax has been correctly settled.

The DGT's ruling

The resident is a taxpayer for Wealth Tax by personal obligation, and must include the bare ownership of the shares. The valuation of said bare ownership is carried out in accordance with the TRLITP and AJD, using the value of the shares as a reference. Regarding the informative declaration of assets abroad, an exemption exists if the combined value of the assets does not exceed 50,000 euros.
