Contribution of private property to community property is exempt if the taxpayer is over 65 and it is their main residence

A taxpayer over the age of 65 enquired whether contributing their private property to a community property regime allows for the exemption on the transfer of a main residence. The DGT ruled that, provided the requirements regarding age and main residence are met, the resulting capital gain will be exempt.

The DGT's ruling

La aportación de un bien privativo a la sociedad de gananciales genera una ganancia o pérdida patrimonial. Al no ser la sociedad de gananciales contribuyente, los sujetos pasivos son los cónyuges. Si el aportante es mayor de 65 años y la vivienda cumple los requisitos de vivienda habitual, la ganancia patrimonial por la aportación estará exenta según el artículo 33.4.b) de la LIRPF.
