Containers and bags for faecal sample collection taxed at the standard 21% VAT rate

A company queried whether its containers and bags for collecting faecal samples from humans and animals could qualify for the reduced 10% VAT rate. The Directorate-General for Taxes (DGT) ruled that they do not, as they are not intended for incontinence nor are they for the exclusive use of people with disabilities.

The DGT's ruling

Los productos para recogida de muestras fecales no se incluyen en la categoría de sistemas para incontinencia urinaria o fecal del Anexo de la Ley. Además, por sus características objetivas, no son productos diseñados para el uso personal y exclusivo de personas con deficiencias físicas, mentales, intelectuales o sensoriales. Por tanto, deben tributar al tipo general del 21%.
