Acquisition of a second-hand commercial premises (excluding land) qualifies for the Canary Islands Investment Reserve

The taxpayer inquires whether the purchase of a second-hand commercial premises can be used to implement the Canary Islands Investment Reserve (RIC). The Directorate General for Taxes (DGT) confirms this is possible, provided the property has not previously benefited from this tax regime.

The question raised

Whether the acquisition of the used premises is suitable for implementing the Canary Islands Investment Reserve (RIC).

The DGT's ruling

Investment in the acquisition of a used premises is suitable for implementing the RIC, always excluding the land value. For it to be valid, the acquired asset must not have previously benefited from the RIC regime. In the case of land, the requirements for allocation provided for in the regulations must be met, which are not met in this case.
