Transfer of goods from Company A to Company B is subject to VAT if transport is not linked to the supply

A company has enquired whether the purchase of goods from a domestic supplier for subsequent export to a third country may be exempt from VAT. The DGT has ruled that the initial supply is subject to VAT because the transport is not linked to it, whereas the final supply to the customer outside the Community will be exempt.

Cuestión planteada Si la entrega efectuada por la Sociedad A a la Sociedad B puede quedar exenta del Impuesto sobre el Valor Añadido en virtud del artículo 21 de la Ley 37/1992.

The DGT's ruling

Para que la entrega de bienes esté exenta por exportación, el transporte debe estar vinculado a dicha entrega y acreditarse mediante documentación aduanera donde el transmitente figure como exportador. En ventas en cadena, si el transporte no se vincula a la primera entrega, esta estará sujeta a IVA. La entrega subsiguiente al adquirente no establecido en el territorio estará exenta si se cumplen los requisitos del artículo 21 de la Ley 37/1992.
