Deductibility of impairment losses on poultry depends on accounting classification as fixed assets or inventory

A poultry company has requested clarification regarding the deductibility of losses caused by diseases in its birds. The DGT has ruled that if the birds are classified as tangible fixed assets, impairment losses are not directly deductible, but must be accounted for through the depreciation of the tax difference. Conversely, if they are classified as inventory, the impairment is directly deductible.

The DGT's ruling

Si las aves son inmovilizado material, las pérdidas por deterioro no son deducibles fiscalmente, debiendo integrarse la diferencia entre el valor contable y fiscal mediante el método de amortización del artículo 20 de la LIS. Si las aves tienen la condición contable de existencias, las pérdidas por deterioro sí son fiscalmente deducibles. En cuanto a la amortización del inmovilizado, será deducible si se corresponde con la depreciación efectiva según el artículo 12 de la LIS.
