40% reduction cannot be applied to pension plans contracted after 2006

The consultant asks whether a 40% reduction under the transitional regime can be applied when redeeming pension plans contracted in 2010 and 2012. The DGT responds that it is not possible because contributions were made entirely after December 31, 2006.

The question raised

Possibility of applying the 40 percent reduction provided for in the transitional regime.

The DGT's ruling

The 40% reduction under the transitional regime applies only to the portion of the benefit corresponding to contributions made until December 31, 2006. If the insured pension plans were contracted after that date, all their contributions are subsequent and do not entitle the holder to said reduction. The benefits from these plans are always considered earned income.
