Rental income from assets under usufruct is attributed to the usufructuary, not the bare owners

A query was raised regarding whether income from the rental of an undivided share of a property belongs to the usufructuary or the bare owners. The Directorate General for Tax (DGT) ruled that such income must be attributed to the usufructuary.

The DGT's ruling

Las comunidades de bienes no son contribuyentes, sino que las rentas se atribuyen a sus miembros según la naturaleza de la fuente. En casos de propiedad dividida, los rendimientos del capital se atribuyen a los titulares de los bienes o derechos. Dado que el usufructuario tiene derecho a percibir los frutos civiles de los bienes usufructuados, la renta del arrendamiento le corresponde a él y no a los nudos propietarios.
