Interest on a joint account is taxed in the residence country

A UK resident enquired who should pay tax on the interest from a joint account holding funds from a property sale. The DGT states that the source of income belongs to the owner of the funds and that, under the double taxation agreement, interest is only taxed in the country of residence.

The DGT's ruling

Los rendimientos de la cuenta se atribuyen a la persona propietaria del dinero depositado, independientemente de que la cuenta esté a nombre de terceros. Si las rentas son intereses y el beneficiario es residente en el Reino Unido, según el Convenio Hispano-Británico, solo pueden someterse a imposición en dicho país. En consecuencia, si se acredita la residencia en el Reino Unido, las rentas están exentas del IRNR y no procede retención.
