The threshold for the obligation to file an IRPF tax return remains at €22,000 in cases of business succession

A query was raised regarding whether the succession of a sole trader by a company constitutes the existence of two different payers for the purpose of the IRPF tax return filing threshold. The DGT ruled that, due to subrogation in the business succession, the company maintains the status of the same payer as the previous sole trader.

Cuestión planteada Se consulta respecto de la obligación de presentar declaración por el IRPF al haber obtenido unos rendimientos del trabajo por un importe inferior a 22.000 euros anuales.

The DGT's ruling

En la sucesión de empresa, el cesionario mantiene la condición de mismo pagador a efectos de determinar el tipo de retención aplicable sobre los rendimientos del trabajo. Por tanto, no se produce la existencia de más de un pagador por el hecho de que los trabajadores pasen a formar parte de la plantilla de la nueva sociedad. Al no haber dos pagadores, se mantiene el límite de exención de la obligación de declarar en 22.000 euros anuales.
