Cádiz court to handle family, child and capacity cases exclusively for three months

The agreement of 17 March 2026 assigns exclusively to seat number 2 in the Civil Section of the Cadiz Instance Court the jurisdiction over family, child and capacity matters, as provided in article 86.3 of Organic Law 6/1985. This administrative distribution within the judicial system does not alter procedures or deadlines. The assignment is final and exclusive for that court in this matter.

In 2 key points

  1. The Cádiz Instance Tribunal acquires exclusive jurisdiction in family, children and capacity matters (art. 86.3 Ley Orgánica 6/1985)
  2. The allocation is exclusive and exhaustive, with no possibility of filing in other courts (art. 86.3 Ley Orgánica 6/1985)

How it affects those involved

The claimants and family, children and capacity lawyers in Cádiz must direct all their cases exclusively to the Cádiz Instance Tribunal. Judges from other courts lose jurisdiction in this area. Judicial authorities must update their records on jurisdiction. Legal advisors must review their defence and representation strategies to ensure cases are filed with the competent court.
