Proxy holders: new method to accept powers of attorney via standardised electronic form

The resolution updates the Annex IV model of Order PCM/1384/2021 to simplify the registration of powers of attorney in the Electronic Registry of Powers of Attorney of the General State Administration (REA-AGE). It allows the acceptance of the power of attorney to be carried out by either the proxy holder or the principal via a standardised electronic form (Art. 1). This removes the need to submit non-standardised notary powers that require legal authentication (Art. 4.4 and 6.3 of Order PCM/1384/2021).

In 3 key points

  1. The acceptance of the power of attorney may be carried out by either the proxy holder or the principal, Art. 1. (art. Primero)
  2. Entry into force on the day following its publication in the BOE, Art. 4. (art. Cuarto)
  3. Use of a standardised electronic form to avoid the legal authentication of notary powers, Art. 4.4 of Order PCM/1384/2021. (art. 4.4)

How it affects those involved

For proxy holders, registration is facilitated without the mandatory need for notary powers, allowing the use of a private document with an electronic signature (Art. 4.4). For public administrations, the management burden and waiting times are reduced by avoiding the authentication process for non-standardised notary powers (Art. 6.3). The process gains agility and administrative simplicity (Art. 3.1 of Law 40/2015).
