Waste production and management entities: obligation to register in the new unified electronic Registry

Royal Decree 764/2026 regulates the Waste Production and Management Registry to comply with Law 7/2022 and Directive (EU) 2018/851. This registry is unique throughout the national territory and shared by all public Administrations, aiming to improve waste traceability and governance (preamble). The system seeks to strengthen electronic registration mechanisms, especially for hazardous waste, by integrating information from autonomous communities into a centralized system.

In 3 key points

  1. The Register is unique throughout the national territory and shared by all public Administrations (preliminary statement). (exposición previa)
  2. Entities without a physical facility (managers, agents, transporters) shall use their registered office or headquarters as their centre (Art. 2.b). (art. 2.b)
  3. A 'Centre' is defined as the technical unit of facilities at the same site under the same owner (Art. 2.a). (art. 2.a)

How it affects those involved

For entities involved in the waste chain (managers, transporters, agents, traders, and producers), the regulation imposes an obligation to transmit and exchange information with the Administrations through a single electronic register (Art. 2.c). Companies with multiple facilities at the same site under the same owner must manage them under the definition of a 'Centre' (Art. 2.a). Treatment managers or extended producer responsibility systems without a physical facility must register their registered office or headquarters as a centre (Art. 2.b).
