Royal Decree 632/2026 expands the annex of Royal Decree 1851/2009 to include new pathologies that allow early retirement for individuals with a disability degree of 45% or higher. This modification addresses the need to maintain an open list of pathologies that reduce life expectancy, following a favorable report from the Technical Commission and the resolution of the General Directorate for Social Security Management. The newly included pathologies are: transthyretin amyloidosis variant, myotonic dystrophy type 1 (Steinert), Huntington's disease, spina bifida, Parkinson's disease, corticobasal degeneration, multiple system atrophy, progressive supranuclear palsy, systemic sclerosis, and stage G5 chronic kidney disease.
Workers with a disability degree of 45% or higher suffering from any of the newly listed pathologies are entitled to early retirement (Art. 206 bis TRLGSS). This represents an improvement in social protection for conditions that reduce life expectancy. No direct changes in costs or management are identified for companies or the self-employed, except for the potential management of sick leave or early retirements of their employees.
