Registration of graphic representation denied due to identity doubts and excess area

The Directorate General for Legal Certainty and Public Faith has confirmed the suspension of the registration of the georeferenced graphic representation of a property in Formentera. The Registrar denied the rectification of the description for property registration no. 484 because the requested excess area (27,509.40 m²) exceeds the registered surface area (44,144 m²) by more than 50%. This raises doubts regarding the identity of the property and could constitute a disguised first registration (Art. 199.2 of the Mortgage Law).

In 2 key points

  1. Denial due to excess area exceeding 50% of the registered surface (nota de calificación)
  2. Impossibility of rectification if there is suspicion of first registration or property overlap (nota de calificación)

How it affects those involved

For the property owner, this ruling prevents the rectification of the surface area and the updating of its graphic representation in the Land Registry. The declared excess area, which significantly increases the registered extent, prevents the operation from being treated as a mere rectification of erroneous data, necessitating the avoidance of suspicions regarding property overlap or the first registration of new plots (Art. 199.2 of the Mortgage Law).
