Municipalities: 3 months to adapt environmental assessment procedures or fines up to 15,000 EUR

The Law 6/2025 modifies Article 31.4 of Law 4/2015 and adds Additional Provision 6, requiring municipalities to assess environmental impacts of urban projects before approving them. This change obliges municipalities to implement a new environmental assessment procedure with a 3-month adaptation period from entry into force (Art. 31.4 and Additional Provision 6).

In 3 key points

  1. Local councils must assess environmental impacts before approving urban projects (art. 31.4)
  2. 3-month period to adapt procedures from date of entry into force (disposición adicional 6)
  3. Fines of up to €15,000 for failure to carry out environmental assessment (disposición adicional 6)

How it affects those involved

Local councils must update their environmental assessment procedures to comply with the new requirement (art. 31.4). Urban projects failing environmental assessment may be rejected. Fines for non-compliance amount to up to €15,000 per breach (additional provision 6). Affected citizens may appeal to the council if they believe the environmental impact was not properly assessed.
