Senate can demand Prime Minister's appearance over rail accidents

The rule allows the Senate to demand the Prime Minister's appearance before the full body on rail accidents, as per Article 73.1 of Law 2/1979. This applies to incidents in Adamuz (Córdoba) on 18 January 2026 and on Rodalies lines R1 and R4 (Catalonia) on 20 January 2026. The Council of Ministers' agreement of 17 March 2026 rejects this demand, but the Constitutional Court declares a constitutional conflict.

In 3 key points

  1. The Senate may demand the President of the Government's appearance following rail accidents (art. 73.1 LO 2/1979)
  2. The Adamuz (18/01/2026) and R1/R4 (20/01/2026) accidents are subject to constitutional demand (texto fuente)
  3. The Council of Ministers Agreement of 17/03/2026 rejects the request but declares a constitutional conflict (texto fuente)

How it affects those involved

The Senate may exercise its constitutional right to demand the President of the Government's appearance in cases of serious rail accidents. The Government faces a legal obligation to explain the causes, which could lead to political pressure. Government advisers must assess the risk of a constitutional conflict and prepare legal responses. Rail administrations must be ready for potential investigations or audits resulting from the Senate's demands.
