Current position

Services provided by artists, directors, and technicians (natural persons) are taxed at a 10% IVA (Value Added Tax) rate when provided to organizers of theatrical or musical works. The organizer is the party who orders the material or human resources for the performance. If the recipient is a mere intermediary without management capacity, the general rate of 21% applies. This includes sound, lighting, tailoring, hairdressing, and makeup technicians performing necessary auxiliary activities.

The DGT's position remains stable at the core of the criterion. The evolution focuses on the precision of the definition of 'organizer' and the delimitation of which technical profiles qualify. Recent rulings have expanded the list of examples of technicians to ensure the application of the reduced rate.

Turning points

  1. V1832-23

  2. V0803-26

Specifies the scope of the technician category by explicitly mentioning sound, lighting, tailoring, hairdressing, and makeup professionals.
