Current position
The obligation to file depends on the occurrence of employment income and other elements such as capital gains or multiple payers. In cases of subrogation or business succession, the assignee maintains the status of the same payer, preventing the application of the multiple payers limit. If there is only employment income from a single payer, the limit is 22,000 euros per year.
The DGT's position remains constant in the application of the limits of article 96 of the LIRPF (Personal Income Tax Law). Recent rulings clarify that business succession does not break the unity of the payer for the purposes of the obligation to file. No doctrinal change is observed, but rather a clarification regarding the continuity of the employer in subrogation processes.
