How the DGT's position has evolved
Current position
Diplomatic missions in Spain do not have their own legal personality nor are they considered permanent establishments as they do not carry out economic activities. Therefore, they are not required to perform withholdings or payments on account on the income they pay to their employees. Employees must file their annual tax return, even if they do not make monthly payments on account.
The DGT's position remains constant in the application of domestic regulations to determine tax residence and tax obligations. No doctrinal change is observed, but rather a technical application of the LIRPF (Personal Income Tax Law) and the IVA (VAT) Law to the various situations of diplomatic missions. The doctrine is stable regarding the legal nature of these entities and their effects on IRPF (Personal Income Tax) and IVA.
Turning points
-
Clarifies that diplomatic missions are not permanent establishments due to the lack of legal personality and the absence of economic activity, which prevents the application of the exemption under article 7.p) of the LIRPF.
-
Establishes that diplomatic missions are not required to perform withholdings or payments on account on the income of their employees.
