Tax base for used vehicles: market value or official tables

Determining the tax base for the Excise Duty on Certain Means of Transport (Impuesto Especial sobre Determinados Medios de Transporte) often raises frequent doubts, especially regarding used vehicles from other European Union Member States that are being registered for the first time in Spain.

What the DGT has ruled

The Dirección General de Tributos (DGT) has specified that, for used means of transport, the tax base is their market value on the date the tax accrues. However, the regulations allow for an alternative to facilitate tax compliance.

The taxpayer has the option to use the average sale prices approved by the Minister if the specific vehicle model is listed in the official valuation tables. In the event that the model is not included in said tables, the tax base must obligatorily be calculated based on the market value of the asset.

A relevant aspect of this ruling is the legal certainty provided by the use of the tables: if the approved average prices are declared, the Administration will not be able to verify the value of the vehicle through other means provided for in the General Tax Law (Ley General Tributaria).

What it means for you

If you are an individual performing the first registration in Spain of a used vehicle imported from the European Union, you should be aware of these two calculation methods. If your vehicle is listed in the valuation tables, you can opt for the established average price, which avoids verification processes by the Administration.

If your vehicle does not appear in the official tables, you cannot use the average prices and must determine its market value to establish the correct tax base.

What you should do

Before proceeding with registration, it is necessary to verify whether your vehicle model is included in the tax valuation tables. This will allow you to determine whether you can apply the average price criterion or if you must perform a market-based valuation.

Given the importance of correctly determining the tax base to avoid contingencies, it is necessary to assess each particular situation in accordance with current regulations.
