Renting a residential property will not be deductible as a business expense

The deductibility of expenses in Personal Income Tax (IRPF) requires a direct connection between the expenditure and the generation of income. Recently, the Dirección General de Tributos (DGT) has clarified the tax treatment of accommodation costs when they serve a residential purpose.

What the DGT has ruled

The query concerned the possibility of including amounts paid for renting a home in the calculation of deductible expenses for an economic activity. The Administration's criterion is categorical: for an expense to be admitted, it must be linked to the activity and be necessary for the generation of income.

In this case, the DGT points out that, as it concerns a property for exclusively residential use, the purpose of the contract is to have a place for occasional residence. Therefore, there is no necessary correlation between the rental of said property and the development of the professional activity, which prevents its application as a deductible expense under the regulations of the LIRPF and the LIS.

What this means for you

This resolution has a direct impact on two specific profiles:

  • Professionals and freelancers: Those who attempt to charge accommodation costs as expenses of their economic activity will not be able to do so if the housing has a strictly residential purpose.
  • Expatriates: Professionals who rent homes abroad to reside occasionally while performing their work will not be able to deduct these amounts in their tax return.

The Administration understands that housing expenses respond to a personal need for residence and not to an operational need of the economic activity.

What you should do

Given the possibility of incurring accommodation expenses during travel or temporary stays, it is fundamental to distinguish between strictly professional accommodation expenses and personal residence expenses. Each situation must be analyzed rigorously to avoid tax contingencies. It is recommended to assess the nature of each rental contract and its real link to the activity to determine its correct tax classification.
