Reinvestment exemption: proportional application based on ownership acquired

The Dirección General de Tributos (DGT) has issued a relevant ruling for individuals selling their primary residence with the intention of reinvesting the proceeds into a new home to reduce their Personal Income Tax (IRPF) burden.

What the DGT has ruled

The inquiry focused on determining whether it is possible to apply the reinvestment exemption when the taxpayer does not acquire the entirety of the new home, but only a portion of it. The DGT establishes that, to qualify for this benefit, both properties must hold the status of primary residence in accordance with Article 41 bis of the Personal Income Tax Regulation (RIRPF).

The ruling confirms that the reinvestment must take place within a period of two years, whether before or after the disposal of the sold property. In the event that the taxpayer acquires only a part of the new home, the exemption will be applied proportionally. The calculation will be carried out based on the amount allocated to satisfy the price of the acquired portion, according to the ownership percentage obtained.

What this means for you

This ruling has a direct impact on individuals who decide to acquire a share of ownership instead of full title to a new residence. If you sell your primary residence and use the money to buy, for example, 50% of another property, the exemption will not be total on the capital gain, but will be limited to the proportional part corresponding to that ownership stake.

What you should do

It is essential to verify that both the sold property and the new one strictly comply with the primary residence requirements established by current regulations. Since the calculation of the exemption will depend directly on the ownership percentage and the amount allocated to said acquisition, it is necessary to accurately document cash flows and the ownership of the new property to avoid discrepancies with the Tax Administration. Each reinvestment situation must be analyzed individually to determine the exact scope of the tax benefit.
