Plastic tax exemption for pet hygiene accessories

The Directorate General of Taxes (DGT) has issued a relevant ruling for the pet products sector regarding the application of the special tax on non-reusable plastic packaging. The inquiry focused on determining whether certain hygiene accessories for dogs should be taxed under this regime.

What the DGT has ruled

The administration has ruled that foldable bags for dogs and excrement bag dispensers are not subject to the tax. The reason is that these products do not fit into the legal categories provided for in the objective scope of the tax.

Furthermore, the ruling establishes that biodegradable bags for dog excrement are also not subject to the tax. The DGT bases this decision on the fact that such bags are used to contain waste and not goods, and therefore do not meet the technical definition of packaging required for the application of the tax. Consequently, both the manufacture and the import or intra-Community acquisition of these products fall outside the scope of this special tax.
