People with disabilities may contribute up to 24,250 euros to their pension plans

The tax treatment of pension plans for people with disabilities presents specific characteristics that allow for a higher capacity for savings and reduction of the taxable base compared to the general regime. The Dirección General de Tributos (DGT) has specified the applicable limits when there is a judicially declared incapacity.

What the DGT has ruled

The ruling establishes that people with disabilities who have a judicially declared incapacity may benefit from a special financial regime for their pension plans. Under this regulatory framework, the following contribution limits have been defined:

  • Contributions from the person with a disability: The maximum annual contribution limit that the person with a disability themselves can make is 24,250 euros.
  • Contributions from relatives or guardians: Relatives or guardians may make contributions with a limit of 10,000 euros each.
  • Global limit: Regardless of who makes the contribution, the total reduction for all persons involved may not exceed the ceiling of 24,250 euros.

The regulations require that the option for this special regime be exercised prior to making the contributions.

What it means for you

If you are a person with a disability with a judicially recognized incapacity, or if you are a direct relative or guardian, you have a greater deduction capacity than a standard taxpayer. While the limits are more restrictive under the general regime, this special regime allows for the optimization of the tax burden through higher contributions to the pension plan.

It is fundamental to understand that the benefit is not unlimited. Although relatives may individually contribute up to 10,000 euros, the sum of all applied reductions cannot exceed the maximum limit of 24,250 euros established for the group.

What should be done

To apply this criterion correctly, it is necessary to verify the existence of the judicial declaration of incapacity. Since the option for this regime must be made prior to the contributions, it is necessary to formalize said choice before executing the financial movements. It is recommended to assess the structure of family contributions so as not to exceed the global reduction limit permitted by the Personal Income Tax (IRPF) Law.
