Companies must register for every IAE heading that classifies their wholesale trade activity

The correct classification of economic activities in the Economic Activities Tax (IAE) is a critical aspect of regulatory compliance for companies. Recently, the Directorate General of Taxes (DGT) has clarified the scope of the registration obligation when a company carries out wholesale trade activities.

What the DGT has ruled

The binding ruling determines that a company must be registered in all headings of the Tariffs that specifically classify the wholesale trade of the items it commercializes. The administration's criterion is strict in this regard: the sporadic nature of an activity or its low economic significance does not exempt one from the registration obligation established in Article 78.1 of the TRLRHL.

Furthermore, the DGT clarifies an important operational distinction: registration in a wholesale trade heading empowers the company to carry out retail sales, but does not authorize it to carry out product transformation processes.

What this means for you

If your company expands its product catalog or diversifies its commercial activity, you must verify that each new line of business is correctly reflected in the IAE. It is not enough to have a general registration if the specific wholesale trade activity of certain items requires a specific heading.

This criterion implies that the economic relevance of the activity is not a determining factor for the registration obligation. If the activity is carried out, it must be duly registered in the corresponding headings, thereby avoiding possible contingencies due to incomplete classification.

What should be done

It is necessary to conduct an analysis of the company's actual activity compared to its current status in the IAE. If the company commercializes products that are not currently covered by its existing headings, it must proceed to expand its activity in the specific headings. It is fundamental to distinguish whether the activity is purely commercial or if it includes transformation processes, as the latter would require a different classification from simple wholesale trade.
