Deduction for investment in main residence cannot be applied to works not classified as rehabilitation

The taxpayer asks whether they can apply the deduction for investment in their main residence for facade rehabilitation works carried out in 2014. The Directorate General for Taxes (DGT) responds that the described works do not meet the legal requirements to be classified as rehabilitation.

The DGT's ruling

Para aplicar la deducción por inversión en vivienda habitual mediante el régimen transitorio, las obras deben ser de rehabilitación según el artículo 41.1 del RIRPF. Esto requiere que sean actuaciones subvencionadas o que tengan por objeto principal la reconstrucción de estructuras, fachadas o cubiertas, siempre que el coste exceda el 25% del valor de la vivienda. Las obras de ocultación de cableado, pintado, protección de celosías, instalación de persianas o tratamiento de aleros no califican como rehabilitación.
