The VAT rate applicable at the time of accrual must be used, not the rate at the time of award

The inquirer asks whether an invoice should be issued using the VAT rate applicable at the time of the contract award or the rate in force when the material is delivered. The DGT rules that the applicable rate is the one in force at the time the transaction accrues.

Cuestión planteada Si el consultante ha de emitir factura aplicando el tipo vigente en el momento de la adjudicación o el tipo vigente en el momento en que se efectúe la entrega.

The DGT's ruling

El tipo impositivo aplicable a cada operación es el vigente en el momento del devengo, según el artículo 90.2 de la Ley 37/1992. En entregas de bienes, el devengo ocurre cuando se pone la mercancía a disposición del adquirente. En contratos con la Administración, se debe aplicar el tipo vigente al realizarse las operaciones, aunque la oferta económica original utilizara un tipo inferior. Si existen pagos anticipados, se aplicará el tipo vigente en el momento del cobro.
