Social security, union fees and legal defence costs are deductible even without employment income

A taxpayer inquired whether social security contributions, union fees, and legal defence costs remain deductible following the termination of their employment. The Directorate General of Taxes (DGT) ruled that these expenses are deductible from gross employment income, even if the resulting net income is negative due to a lack of earnings.

The DGT's ruling

Los gastos por cotizaciones a la Seguridad Social, cuotas a sindicatos y gastos de defensa jurídica por litigios con el empleador son deducibles. Esta deducción es posible sin perjuicio de que el rendimiento neto resulte negativo ante la ausencia de ingresos por rendimientos del trabajo.
