Taxation of employment income in China depends on the taxpayer's tax residence

A tax resident in Spain working in China for between 186 and 190 days a year seeks clarification on whether their income is exempt in Spain. The DGT explains that the outcome depends on determining tax residence according to domestic law and the Double Taxation Convention between Spain and China.

The DGT's ruling

Si el consultante es residente fiscal en España, tributará por su renta mundial, pero las rentas del trabajo que puedan tributar en China estarán exentas en España según el Convenio, aunque se integrarán para calcular el tipo medio de gravamen. Si no es residente fiscal en España, solo tributará en España por las rentas que deriven de una actividad personal desarrollada en territorio español.
