Long-term care insurance premiums exceeding the joint financial limit are not deductible for IRPF purposes

A taxpayer inquired whether they could apply pending reductions from long-term care insurance premiums paid in previous years to their 2022 tax return. The Directorate General for Taxes (DGT) ruled that deductions are only permitted for excesses resulting from insufficient taxable base or the percentage limit, not for amounts that exceed the maximum financial limit.

The question raised

Possibility and method of reducing pending excesses in the personal income tax (IRPF) taxable base for the 2022 tax year.

The DGT's ruling

Private long-term care insurance premiums only allow for a reduction if they do not exceed the joint financial limit for contributions to social security systems. If the excess is due to having exceeded said maximum limit, the reduction cannot be applied in the following five tax years. In such cases, by reference to pension plan regulations, the amounts paid in excess must be returned.
