Income from stock sales and goodwill gains are attributed to the individual owner of the pharmacy

Two pharmacists, previously part of a community of property, are selling their respective pharmacies and have requested guidance on how to quantify and attribute the resulting profits. The DGT clarifies that income from stock sales constitutes earnings from each owner's individual business activity, whereas goodwill is attributed to the person who holds the ownership of the pharmacy.

The question raised

Method for quantifying the capital gain obtained from said transfer and its attribution for Personal Income Tax purposes.

The DGT's ruling

The sale of inventory generates income from economic activity which is attributed entirely to the exclusive holder of the activity. The gain or loss on fixed assets is calculated as the difference between the transfer value and the book value. Goodwill is attributed to each pharmaceutical entity according to the ownership of its office, whereas fixed assets held in joint ownership are attributed to both parties in equal shares.
