Official certificate required for large family tax deduction, but minimum allowance for descendants or maintenance annuities may apply

A divorced taxpayer with three children in their mothers' custody asks whether they can claim the large family tax deduction and maintenance allowances. The DGT rules that they are not entitled to the large family deduction due to the lack of an official certificate, but they may choose between applying the minimum allowance for descendants or the treatment of maintenance annuities.

The DGT's ruling

Para la deducción por familia numerosa es imprescindible acreditar la condición mediante el título oficial otorgado por la comunidad autónoma. Respecto a los hijos sin convivencia, el progenitor que paga alimentos por resolución judicial puede optar entre aplicar el mínimo por descendientes (prorrateado entre progenitores) o el régimen de especialidades de los artículos 64 y 75 de la LIRPF. Para aplicar las especialidades por alimentos, debe satisfacerse efectivamente la cuantía fijada judicialmente.
