Dividends taxed on savings base even if reinvested in new shares

A taxpayer asks whether dividends from a listed company, reinvested in new shares, have special tax treatment. The DGT responds that such dividends must be included in the savings tax base.

The question raised

Tax treatment of dividends received within the Personal Income Tax of the applicant.

The DGT's ruling

Dividends are classified as full returns from movable capital pursuant to Article 25.1.a) of the Personal Income Tax Law (LIRPF). These amounts must be included in the savings tax base in accordance with Article 49.1.a) of the law, regardless of whether they are reinvested in the acquisition of new shares. The exemption for the first 1,500 euros was abolished as of January 1, 2015.
