Benefit-in-kind for the private use of rental vehicles is calculated based on their market value as if they were new

A company inquires about how to value the benefit-in-kind for employees who use rental vehicles for private purposes. The DGT indicates that the market value of the vehicle must be used as if it were new and that the allocation criterion must be based on availability rather than mileage.

The question raised

Given that the vehicles have mixed use (professional and private), the question concerns the determination of the benefit-in-kind corresponding to private use.

The DGT's ruling

For rental vehicles, the valuation of private use is 20 percent per annum of the market value of the vehicle as if it were new. The allocation between professional and private use must be based on availability for private purposes; criteria based on hours of use or mileage are not valid. The presence of company logos on the vehicle does not alter the classification as a benefit-in-kind.
