Deposit interest not taxable in IRPF if due after loss of Spanish residency

A taxpayer asks whether interest from a deposit to be received in 2015, the year they cease to be a Spanish resident, should be declared in their IRPF. The DGT responds that such interest is not taxable in the IRPF as it is due during a period when the taxpayer is no longer a resident, but may be taxable under the Non-Resident Income Tax.

The question raised

Whether the interest received upon the maturity of the deposit must be declared as income from movable capital in the Personal Income Tax.

The DGT's ruling

Interest from a deposit is classified as income from movable capital pursuant to Article 25.2 of the Personal Income Tax Law (LIRPF). This income is attributed to the tax period in which it becomes due to the recipient. If the interest is due in a period during which the taxpayer does not hold the status of a tax resident in Spain, it is not subject to Personal Income Tax, without prejudice to its possible taxation under the Non-Resident Income Tax.
