Tax residence in Spain determines taxation on worldwide income and treatment of Portuguese income

A taxpayer residing in Spain for most of the year asks how to report their income, including rental income and a pension from Portugal. The DGT explains that if they are a tax resident in Spain, they must be taxed on their worldwide income and details the treatment of real estate income and pensions under the Double Taxation Convention with Portugal.

The DGT's ruling

La residencia fiscal se determina por la permanencia más de 183 días en el año natural o por tener el núcleo de intereses económicos en España. Como residente, se tributa por la renta mundial, incluyendo alquileres de inmuebles en España (rendimientos del capital inmobiliario) y en Portugal. Los inmuebles no arrendados tributan por imputación de rentas inmobiliarias. Las pensiones privadas de Portugal por empleo anterior solo tributan en España, salvo que sean pensiones públicas, en cuyo caso tributan en Portugal a menos que el beneficiario sea nacional español.
