Taxation depends on tax residence and meeting requirements for foreign employment exemption

A worker inquired whether they should be taxed in Spain or South Africa upon relocating for work. The DGT clarifies that taxation will depend on whether they maintain tax residence in Spain and whether they meet the requirements for the exemption on income from employment performed abroad.

The DGT's ruling

Si el consultante es residente fiscal en España, tributará por su renta mundial, aunque podrá aplicar la exención del artículo 7.p de la LIRPF si trabaja para una entidad no residente y el país no es paraíso fiscal. Si es residente en España y trabaja en Sudáfrica, existe tributación compartida según el Convenio, debiendo España evitar la doble imposición. Si no es residente fiscal en España, solo tributará por las rentas de fuente española.
