VAT on organisation and execution of children's theatre shows taxed at 21%

A federation of theatre companies has consulted whether billing for children's shows to local councils or non-profit entities attracts a different tax rate. The Directorate General for Taxes (DGT) has ruled that these activities are neither exempt nor subject to the reduced rate, meaning the standard rate must be applied.

The question raised

The DGT's ruling

Las representaciones teatrales solo están exentas si las prestan entidades de Derecho Público o establecimientos culturales privados de carácter social. Los servicios de organización y ejecución de espectáculos de teatro infantil no se consideran prestaciones de asistencia social. Al no estar incluidos en los supuestos de exención ni en el tipo reducido del artículo 91, tributan al tipo general del 21%.
