Refund of erroneously charged interest is not income, but received statutory interest constitutes a capital gain

A taxpayer received a refund of mortgage interest unduly charged due to an unagreed floor clause, along with statutory interest. The DGT has ruled that the refund of the principal amount does not constitute income, but the statutory interest received is taxed as a capital gain within the savings tax base.

The question raised

The DGT's ruling
