Lombard loan debt is deductible if proven to be used for the acquisition of property in Spain

A resident in Denmark inquired whether they could deduct the debt from a Lombard-type loan to reduce their Wealth Tax taxable base. The Directorate General for Taxes (DGT) ruled that the debt is deductible provided it is proven that the capital was used for the acquisition of property located in Spain.

The DGT's ruling

Los no residentes son sujetos pasivos por obligación real sobre bienes en territorio español. En estos casos, solo son deducibles las deudas por capitales invertidos en dichos bienes. Por tanto, la deuda es deducible por su destino, siempre que se acredite que se destinó a la adquisición del inmueble en España, con independencia del tipo de préstamo otorgado.
