Agreed 'average price' with third-party suppliers is valid as transaction value for VAT taxable base

A company enquired whether it could use a 'pooled price' for its fruit product imports. The DGT ruled that such a price constitutes the valid transaction value for determining the VAT taxable base and customs duties.

The question raised

Taxable person and deduction of the import VAT amounts incurred in the import operation.

The DGT's ruling

The customs value is determined by the transaction value method, where the price actually paid or to be paid is that agreed upon with the suppliers. In this case, the 'average price' constitutes said price. The VAT taxable base shall result from adding to the customs value the customs duties and other concepts provided for by law. The right to deduct the import tax requires possession of the settlement document issued by the Administration.
