Sale of books to students subject to 4% VAT and not eligible for teaching exemption

An English language teaching centre enquired whether the sale of its own textbooks to students was exempt from VAT. The DGT ruled that the supply of goods for consideration is expressly excluded from the teaching exemption; therefore, the 4% rate must be applied.

The question raised

Question raised: Value Added Tax treatment of the sale of books.

The DGT's ruling

The supply of books for consideration is not exempt under Article 20.One.9º of the VAT Law, as the supply of goods is expressly excluded from said rule. If the sale of books is an ancillary activity (sold to the students themselves and does not exceed 15% of the teaching volume), the pro rata rule shall apply. If it constitutes a separate sector, the deduction regime for separate sectors shall apply.
