Acquiring Spanish tax residence requires taxation on worldwide income

A resident of China wishing to invest in rental properties asks whether they must declare their worldwide income if they become subject to Personal Income Tax (IRPF) in Spain. The Directorate General for Taxes (DGT) responds that, if the criteria for tax residence are met, the taxpayer must be taxed on all income regardless of its source.

The DGT's ruling

Si una persona física cumple los criterios de residencia habitual en España (permanencia de más de 183 días o núcleo de intereses económicos), será contribuyente del IRPF y tributará por su renta mundial. Este criterio se aplica sin perjuicio de lo establecido en los Convenios para evitar la doble imposición aplicables. En caso de no ser residente, las rentas por arrendamiento de inmuebles en España tributarán por el IRNR.
