Compensation for increased asset costs in an economic activity is taxed as business income

A retiree asks how to tax compensation received for the increased cost of purchasing trucks for their former business. The DGT rules that the cost increase constitutes business income, while any interest paid is classified as a capital gain.

The question raised

Taxation under Personal Income Tax.

The DGT's ruling

Compensation for the cost overrun of assets used for an economic activity is taxed as income from economic activity, even if the taxpayer is already retired. Professional fee expenses for the claim are also considered income from economic activity. The late payment interest received is compensatory in nature and must be taxed as a capital gain integrated into the general tax base. The temporal imputation of this income is carried out according to the accrual principle, pursuant to Corporate Tax regulations.
