The acquisition value of shares received as a dividend in kind is their market value

A shareholder received shares from another company as a dividend and subsequently sold all their shares. The DGT clarifies how to determine the acquisition value for both the original shares and those received in kind.

The question raised

Acquisition value of said shares for the purpose of calculating the capital gain obtained in Personal Income Tax.

The DGT's ruling

Shares received as a dividend in kind must be valued at their market value pursuant to Article 43.1 of the Personal Income Tax Law. This market value shall constitute the acquisition value of said shares for the taxpayer. On the other hand, the acquisition value of the shares already held by the shareholder is not altered by the transaction, remaining the actual acquisition cost plus inherent expenses and taxes.
