Donation of company shares may be exempt from Personal Income Tax if requirements under Article 20.6 of the Inheritance and Gift Tax Law are met

The taxpayer asks whether capital gains arising from the donation of shares in a limited company to their children may be exempt from Personal Income Tax (IRPF). The Directorate General for Taxes (DGT) responds that the exemption will apply provided the requirements set out in Article 20.6 of the Inheritance and Gift Tax Law are satisfied.

The question raised

The DGT's ruling
